TERMS AND CONDITIONS
1. Introduction
These Terms and Conditions govern the use of services provided by Fibrelink Limited (“we”, “our”, “us”). By subscribing to or using any of our services, you agree to be bound by these Terms.
2. Scope of Services
Fibrelink Limited provides IT and connectivity services including but not limited to:
· Internet and ISP services
· VPN and VPS services
· Web, Email, and WordPress Hosting
· Network design, firewall, and IP engineering
· Server management and disaster recovery
· CCTV installation and support
Service availability may vary by location and technical feasibility.
3. Service Provision
We strive to provide reliable and uninterrupted services; however, service performance may be affected by factors beyond our control, including maintenance, power outages, upstream provider issues, or force majeure events.
4. Acceptable Use Policy
Clients must not use Fibrelink services for:
· Illegal activities
· Distribution of malware, spam, or harmful content
· Unauthorized access, hacking, or network abuse
· Activities that violate Kenyan law or international regulations
Fibrelink reserves the right to suspend or terminate services for violations.
5. Payments & Billing
· All services are billed as per agreed packages and billing cycles
· Fees must be paid on or before the due date
· Late payments may result in service suspension
· Setup, installation, or activation fees are non-refundable unless stated otherwise.
6. Data Protection & Privacy
Fibrelink Limited respects client privacy and handles data in accordance with applicable data protection laws. We do not sell or share customer data with third parties without lawful justification.
7. Limitation of Liability
Fibrelink Limited shall not be liable for:
· Indirect or consequential damages
· Data loss not covered under an agreed backup service
· Service interruptions beyond reasonable control
Clients are encouraged to maintain independent backups unless subscribed to our backup solutions.
8. Disaster Recovery & Backup
Disaster recovery and backup services are provided only where explicitly contracted. Fibrelink is not responsible for data loss where backup services are not included in the service agreement.
9. Equipment & Installation
Any equipment supplied or installed remains the property of Fibrelink Limited unless otherwise agreed. Clients are responsible for safeguarding installed equipment.
10. Service Suspension & Termination
We reserve the right to suspend or terminate services due to:
· Non-payment
· Breach of terms
· Illegal or abusive usage
· Regulatory or legal requirements
11. Changes to Terms
Fibrelink Limited may update these Terms from time to time. Continued use of services constitutes acceptance of the revised terms.
12. Governing Law
These Terms and Conditions are governed by the laws of the Republic of Kenya.
